Doxpop Property Watch - Terms of Service

END USER AGREEMENT

Use of the Doxpop, LLC, (herein "Doxpop") Property Watch service (herein "Doxpop Property Watch") is conditioned on the acceptance of the following terms and conditions. By registering to use Doxpop Property Watch, the registered user (herein "User") agrees and accepts the terms and conditions contained in this User Agreement.

Accuracy and Reliability of Information

Doxpop, as the service and technology provider, and the county, as the provider of the information (herein "County"), do not represent or endorse the accuracy or reliability of any of the information accessed from Doxpop Property Watch. Doxpop reserves the right, in its sole discretion and without any obligation, to make improvements to, or correct any error or omissions in any portion of Doxpop Property Watch.

Doxpop and County have tried to ensure that the information contained in this electronic system is accurate. Assessing the accuracy and reliability of information is the responsibility of the user. Doxpop and County are not responsible for the accuracy, copyright compliance, legality or decency of material contained in sites listed in Doxpop Property Watch, its links or in the information accessed. Doxpop and County shall not be liable for errors contained herein or for any damages in connection with the use of the information contained herein.

Limitations on Use

User represents and warrants that it will not use Doxpop Property Watch in a manner that infringes, violates, or misappropriates any rights of Doxpop or any third party. User further represents and warrants that: (a) the information provided in connection with registering for Doxpop Property Watch is accurate and complete; (b) that User is at least eighteen years of age and has the legal capacity to enter into this Agreement; and (c) that the individual registering as User has an interest in the property being watched, an individual authorized by the individual with the interest in the property being watched, or the authorized representative of any such entity becoming such a User. User shall at all times use Doxpop Property Watch and the information obtained from it in compliance with all applicable federal, state and local laws, statutes, rules, regulations and ordinances.

User hereby agrees to protect, indemnify, defend and hold harmless Doxpop, County, and all third parties from and against any and all costs, claims, demands, damages, losses and liabilities (including actual attorneys' fees) arising from or in any way related to use of information by the User (or any third party receiving such information from or through the User) furnished by or through the Doxpop Services to the extent such costs, claims, demands, damages, losses or liabilities (including actual attorneys' fees) do not result from the grossly negligent acts or omissions of Doxpop, County, or third parties.

The information obtained through Doxpop Property Watch may be displayed and printed for your personal, non-commercial use only. You may not reproduce, re-transmit, distribute, disseminate, self-publish, broadcast or circulate the information to anyone, without the express written consent of Doxpop. This Internet site is not under the management or control of County and is not governed by the privacy or security policies of County.

Privacy

All use of Doxpop Property Watch is subject to the Doxpop Property Watch Privacy Policy, as set forth on Doxpop Property Watch and amended from time to time.

Disputes and Notice

Any dispute relating in any way to User's use of Doxpop Property Watch or to products or services provided by Doxpop or its affiliates shall be adjudicated in any state or federal court in Wayne County, Indiana, and User consents to exclusive jurisdiction and venue in such courts. User further acknowledges that Doxpop's rights in Doxpop Property Watch are of a special, unique, extraordinary character, giving them peculiar value, the loss of which cannot be readily estimated and may not be adequately compensated for in monetary damages. By using Doxpop Property Watch, User agrees that the laws of the State of Indiana, without regard to principles of conflicts of laws, will govern this Agreement and any dispute of any sort that might arise between User and Doxpop. The parties expressly exclude application of the United Nations Convention for the International Sale of Goods to this Agreement.

Except as otherwise provided set forth herein, notices made by Doxpop to User under this Agreement that affect Doxpop's customers generally will be posted on the Doxpop website. Notices made by Doxpop under this Agreement for User or User's account specifically will be provided to User via the email address provided in the registration for Doxpop Property Watch or in any updated email address you provide to us in accordance with standard account information update procedures Doxpop provides from time to time. It is the responsibility of the User to keep its email address current, and the User will be deemed to have received any email sent to any such email address upon our sending of the email, whether User actually receives the email. In the event User is County, which has obtained authorization by the party with interest, it shall be the sole and absolute obligation of County to ensure any applicable notices are passed along to the party with interest. For notices made by User under this Agreement and for questions regarding this Agreement or Doxpop Property Watch, User may contact Doxpop as follows:

All communications and notices to be made or given pursuant to this Agreement shall be in the English language.

Entire Understanding

This Agreement sets forth the entire understanding and agreement between Doxpop and User regarding the subject matter herein and supersedes any prior or contemporaneous oral or written agreements or representations, except that access to and use of third party services may be governed by terms and conditions different than or in addition to those herein. By use of Doxpop Property Watch, the User agrees to, and shall comply with, such different and/or additional changes to this Agreement as Doxpop shall make from time to time by notice to the User on-line, or in writing.

Disclaimer of Warranties

The service and materials are provided by Doxpop on an 'as is' and 'as available' basis, and Doxpop and County expressly disclaim any and all warranties, express or implied, including without limitation warranties of merchantability and fitness for a particular purpose, with respect to the service or any materials and products. In no event shall Doxpop or County be liable for any direct, indirect, incidental, punitive, or consequential damage of any kind whatsoever with respect to the service, the materials and the products. Doxpop and County do not warrant that the functions contained in the web site or any material or content will be uninterrupted or error free, nor that defects will be corrected, or that the web site or the server that makes it available is free of viruses or other harmful components.
